ImaginePad - Terms of Use

1. Introduction

These Terms of Use ("Terms") govern your access to and use of the ImaginePad mobile application (the "Service"), provided by InnovationBox - INBO Tasarim ve Danismanlik LTD ("InnovationBox," "we," "us," or "our"), located in Istanbul, Turkey. By accessing or using the Service, you agree to be bound by these Terms.

2. Eligibility and Supervised Use

The Service is intended for individuals aged eighteen (18) and older. An adult may allow a minor to access or use the Service under their active supervision. In such cases, the adult remains fully responsible for the minor's use of the Service, including any content generated, shared, uploaded, or processed through the Service. This includes responsibility for any photographs or images submitted on behalf of or by the minor. InnovationBox assumes no responsibility for use by minors.

3. Description of the Service

ImaginePad is an iOS application that enables users to create and transform visual content through AI-assisted features. Core features include: generating coloring book pages from text prompts or descriptions; transforming uploaded photographs into coloring book pages; coloring and editing generated artwork within the app; transforming drawings and sketches into stylized art; and collaborative creation features that allow multiple users (such as family members) to work on the same artwork simultaneously. The ImaginePad website is provided for informational purposes only.

4. User Content and Ownership

You retain all ownership rights in any content you submit, upload, or generate through the Service ("User Content"). By using the Service, you grant InnovationBox a limited, non-exclusive, royalty-free, worldwide license to process User Content solely for the purpose of operating, maintaining, and improving the Service.

5. AI Processing and Third-Party Services

The Service relies on third-party artificial intelligence service providers, including but not limited to OpenAI and Fal.ai. User Content, including uploaded photographs and text prompts, may be transmitted to these providers for processing. InnovationBox does not control, monitor, or guarantee how such third-party services process data or generate outputs, and is not responsible for their practices or results.

6. Content Safety and Family-Friendly Environment

ImaginePad is designed to provide a safe and family-friendly creative environment. We implement content filtering and moderation measures to help ensure that AI-generated outputs are appropriate. However, no automated content filtering system is perfect. Supervising adults are encouraged to review content generated within the Service. Users agree not to use the Service to generate content that is violent, sexually explicit, hateful, or otherwise inappropriate.

7. User Responsibilities

You represent and warrant that you have all necessary rights and permissions to submit User Content, including photographs of individuals. If you upload photographs of other people, you are responsible for obtaining their consent. If you upload photographs of minors, you represent that you are the parent or legal guardian of the minor or have obtained consent from their parent or legal guardian. You are solely responsible for ensuring that your User Content complies with applicable laws and does not infringe the rights of any third party.

8. Subscriptions and Billing

ImaginePad offers subscription plans through Apple In-App Purchases, including weekly and monthly options, and may offer a free trial period. Subscriptions automatically renew unless canceled through your Apple ID account. All billing, refunds, and cancellations are handled exclusively by Apple, and InnovationBox does not store payment information.

9. Prohibited Uses

You agree not to misuse the Service, including but not limited to:

  • Engaging in any unlawful activity.
  • Generating content that is violent, sexually explicit, hateful, or harmful.
  • Infringing intellectual property rights of any third party.
  • Attempting to reverse engineer, decompile, or disassemble the Service.
  • Abusing system resources or attempting to circumvent content filtering mechanisms.
  • Using the Service in any manner that could harm minors.

10. Suspension and Termination

InnovationBox may suspend or terminate access to the Service at any time, without notice, if you violate these Terms or if your use poses a risk to the Service, InnovationBox, or third parties.

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. InnovationBox disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, InnovationBox shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Service.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes shall be subject to the exclusive jurisdiction of the courts of Turkey.
